  • Material is to be burned in such a manner as to minimize the emission of smoke.
  • If burning creates a nuisance and complaints are received you will be asked to put the fire out.
  • Wood only shall be burned and in such a manner as to minimize the emission of smoke. (DO NOT burn tires, trash, paints, or any other hazardous and/or toxic materials).
  • Burning shall be in a Fire Ring, Fire Pit or other structure designed for a fire and shall be no larger than three (3) feet in width. Flames are not to exceed four (4) feet in height.
  • An authorized Town representative may inspect all burning sites.
  • You must have the burning permit at the burn site during the burn.
  • Violations of the burning ordinance are punishable by a fine of not less than $175.00 plus cost of fire suppression in the event the Fire Department is called.
  • Fire shall be controlled at all times; Permit holder shall be liable for any cost of fire suppression in the event the fire is out of control. In the event the Permit holder does not pay for the cost of fire suppression, the amount owed shall be placed on the tax roll of the property where the burning took place. Current minimum cost of suppression is $600.00 per hour.
  • IF A FIRE BECOMES OUT OF CONTROL CALL 911 IMMEDIATELY.

I understand that the permit is issued on the basis that the above conditions are met and in accordance to Shelby Town Ordinance 2.01

This is an annual permit and expires in the current year.
